IRU Position on the proposal for a regulation on compensations for non-compliance with contractual quality requirements applied to rail freight services, (2005)

The adoption by the European Commission of the third railway package in March 2004 was meant to enhance the general railway freight service. Among the four proposals contained in the package, one focuses on compensation in cases of non-compliance with contractual quality requirements for rail freight services and sets the basis of a compensation scheme in case of loss, damage or delays. The IRU welcomes such a proposal but calls for an even more stringent regulatory approach. It also asks that capacity problems at terminals be addressed as these often create delays in delivery.
