Romania: Temporary derogations of the provisions on driving times, breaks and rest periods

The existing emergency situation on Romanian territory caused by the military conflict in Ukraine is disrupting Romanian road hauliers, with long delays at border crossing points, and on traffic generated by the growing influx of refugees from Ukraine. This also influences the possibility for professional drivers to comply with the driving times, breaks and rest periods mandated by the legislation in force.

In addition, taking into consideration other restrictions imposed on road hauliers by the new provisions of the Mobility Package I, which entered into force recently, in order to ensure higher efficiency in supply chains, the Minister of Transport and Infrastructure has approved the following:

From 15 March to 13 April 2022, temporary derogation of the provisions on driving times, breaks and rest periods applies in Romania for the transport of goods carried out with vehicles with a maximum permitted weight of 3.5 tonnes or more.

Temporary derogation from Regulation (EC) No 561/2006 applies as follows:
- The daily driving time may not exceed 11 hours
- The maximum weekly driving time may be increased to 60 hours
- The maximum driving time per two consecutive weeks may be increased to 96 hours
- The maximum driving time before a break may be increased to 5.5 hours
- The normal weekly rest period of at least 45 hours may be taken in the vehicle

Drivers who take advantage of this derogation must enter handwritten cases on the back of the analogue tachograph record sheet or the digital tachograph printout.
