IRU Position on the application of the Posting of Workers Directive to cabotage operations in road transport, (2008)
The Posting of Workers Directive applies to workers providing services in EU Member States other than the state in which they are employed. It requires companies to give such workers the same pay and benefits as those workers based in States where the service takes place. The IRU considers that the current Posting of Workers Directive is not suitable for the road transport sector as it does not take into account the sector’s highly mobile workforce, transnational character nor the administrative burdens and enforcement difficulties of applying it to road cabotage operations. The development of suitable provisions and or the elimination of undue administrative burden must take place before the Directive can be applied.
