IRU Commssion on Legal Affairs (CAJ)

Objectives:
- Observe and analyse the legal environment of international road transport of passengers and goods, in order to inform the people in the profession and boost the legal structure of road transportation through opinions, recommendations and conclusions addressed to the organs of the IRU;
- Contribute to facilitate the contractual relationships between road carriers and their partners.
Working Programme:
- Inform the organs and the members of the IRU (passengers, goods) about the regulatory requirements in the profession and about the legislative projects (multilateral agreements, EU regulations, laws, etc…) in connection with international road transport and related activities (i.e. topics relating to contractual and non-contractual responsibilities, contracts concluded at arm’s length, misleading advertising, protecting the users, travel agents, hotels, maritime and fluvial roll-on roll- off, piggyback, multimodal and intermodal transport).
- Gather, supervise and prepare analyses, legal opinions, recommendations, standpoints and adopt resolutions, in order to protect the interests of international road transport (passengers and goods).
- Contribute to the elaboration and harmonisation of international road transport law, to the simplification of procedures related to this transport mode, to the facilitation of relationships between road carriers and their clients and also to support regional or national efforts in this field.
- Follow up the finalised work of the Commission (in particular administrative and/or penal sanctions in case of lack or non-conformity of the documents accompanying an international transport of passengers or goods by road, the framework agreement on transport, the framework agreement on logistic services, liens and guarantees covering transport of goods by road, the AIH-IRU Convention and standard contracts, the FUAAV-IRU Convention and standard contracts, the IRU model of agreement on exchange of electronic data between business partners within the framework of international road transport of goods, to draw closer the legislations in countries which have adhered to the CMR Convention, relating to national road transport of goods on behalf of a third party; piggyback; maritime roll-on roll-off).
- Cooperate with the appropriate departments of the international governmental organisations (i.e. UNO in Geneva, UNO in Vienna, EU in Brussels, the CEI, UNIDROIT) and the non-governmental organisations (i.e. IHA, ETAG, FUAAV, FIATA, ICC), in the implementation of the above mentioned targets and, if necessary, take part in their work sessions.
